Please read these Terms of Use carefully before accessing or using the services provided by oakpartners ("we", "us", or "our") through oakpartners (the "Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Acceptance of Terms
By creating an account, enrolling in a workshop, or otherwise interacting with any part of the Platform, you enter into a binding agreement with Oakpartners. These Terms apply to all visitors, registered users, and any other individuals who access or use the Platform in any capacity.
We reserve the right to update or modify these Terms at any time. When changes are made, the updated version will be posted on this page with a revised date. Continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
2. Eligibility
You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
3. Account Registration
3.1 Account Creation
Certain features of the Platform require you to register for an account. When creating an account, you agree to provide accurate, current, and complete information and to keep that information updated at all times.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms or engaged in conduct harmful to other users, third parties, or the Platform.
4. Use of the Platform
4.1 Permitted Use
You may use the Platform solely for lawful, personal, and non-commercial educational purposes unless you have entered into a separate written agreement with us permitting commercial use. Access to the Platform is granted on a limited, non-exclusive, non-transferable basis.
4.2 Prohibited Conduct
You agree not to engage in any of the following activities:
Unauthorised Access: Attempting to gain unauthorised access to any part of the Platform, its servers, or any system connected to the Platform.
Harmful Content: Uploading, transmitting, or distributing any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.
Interference: Disrupting or interfering with the integrity, performance, or availability of the Platform or its underlying infrastructure.
Scraping and Extraction: Using automated means, including bots, crawlers, or scrapers, to collect data or content from the Platform without our prior written consent.
Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of any software used in connection with the Platform.
Impersonation: Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
Resale: Reselling, sublicensing, or otherwise commercialising access to the Platform or its content without express written authorisation from Oakpartners.
5. Intellectual Property
5.1 Platform Content
All content available on the Platform, including but not limited to course materials, workshop assignments, exercises, text, graphics, logos, audio, video, and software, is the exclusive property of oakpartners or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership right in any Platform content.
5.2 Limited Licence
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform content solely for your personal educational purposes. This licence does not permit you to reproduce, distribute, publicly display, or create derivative works from any Platform content without our prior written consent.
5.3 User-Submitted Content
If you submit, upload, or post any content to the Platform, including assignments, comments, or exercise responses, you grant oakpartners a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display such content for the purposes of operating and improving the Platform. You represent and warrant that you have all necessary rights to grant this licence and that your content does not infringe any third-party rights.
6. Payments and Enrolment
6.1 Fees
Access to certain workshops, programmes, or features may require payment. All applicable fees will be clearly communicated prior to purchase. By completing a purchase, you authorise us to charge the specified amount using your chosen payment method.
6.2 Refunds
Refund eligibility is determined by the refund policy applicable at the time of purchase. Unless stated otherwise, all payments are final once access to course materials has been granted. If you believe you are entitled to a refund, please contact us at [email protected] within the timeframe specified in the applicable policy.
6.3 Pricing Changes
We reserve the right to modify our pricing at any time. Changes in pricing will not affect enrolments that have already been completed and paid for.
7. Third-Party Services and Links
The Platform may contain links to or integrations with third-party websites, tools, or services. These are provided for convenience only and do not constitute an endorsement by Oakpartners. We have no control over the content, privacy practices, or availability of third-party services and accept no responsibility or liability for them. Your use of any third-party service is governed by that service's own terms and policies.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
9. Disclaimers
The Platform and all content provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that any specific outcome or result will be achieved through use of the Platform.
Educational content is provided for informational and skill-development purposes only. oakpartners does not guarantee employment, certification, or any specific professional outcome as a result of completing any programme or workshop.
10. Limitation of Liability
To the fullest extent permitted by applicable law, oakpartners and its directors, employees, contractors, licensors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or service interruption, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the total amount paid by you to oakpartners in the twelve months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless oakpartners and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
12. Modifications to the Platform
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.
13. Termination
These Terms remain in effect for as long as you use the Platform. We may terminate or suspend your access at any time, with or without cause, with or without notice. Upon termination, all licences granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination shall continue to apply.
14. Governing Terms
These Terms represent the entire agreement between you and oakpartners with respect to your use of the Platform and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
